FemPowered Community, Advisory, Events & Services
These Terms and Conditions apply to services, memberships and events provided by FemPowered Pty Ltd (ABN 84 698 269 288) ("FemPowered", "the Company", "we", "us" or "our").
By purchasing a membership, engaging FemPowered for Advisory Services, booking an event or otherwise purchasing a FemPowered service, you agree to these Terms and Conditions.
Nothing in these Terms and Conditions excludes, restricts or modifies any rights you may have under the Australian Consumer Law or other applicable legislation that cannot lawfully be excluded.
1. Our Services
Community
"Community" means FemPowered's ongoing membership offering, which may include in-person and online sessions, facilitated discussions, learning experiences, resources, community activities, member events and other benefits communicated by FemPowered from time to time.
Specific inclusions, pricing and current benefits will be communicated at the time of joining and may evolve in accordance with these Terms.
Advisory Services
"Advisory Services" means FemPowered's Advisory, Advisory+ and Embedded Advisory services, or another advisory engagement agreed in writing between FemPowered and a client.
The specific scope, frequency, pricing and deliverables of an Advisory engagement will be set out in the relevant proposal, agreement or written confirmation.
Events
"Events" include retreats, intensives, workshops, masterclasses, dinners, facilitated experiences and other separately ticketed FemPowered events.
Specific event inclusions and booking conditions will be communicated at the time of purchase.
2. FemPowered Community Membership
Ongoing Membership
FemPowered Community membership is an ongoing monthly subscription unless otherwise expressly stated at the time of purchase.
Membership fees are charged monthly in advance using the payment method provided at registration.
Cancellation and 28-Day Notice
Members may cancel their Community membership at any time by providing at least 28 days' written notice to:
Membership and access to Community benefits will continue during the 28-day notice period.
Any membership payment that falls due during the applicable notice period will remain payable. Membership will end at the conclusion of the notice period.
Cancellation is effective once written notice has been received by FemPowered.
Nothing in this provision limits any cancellation, refund or other rights available under Australian Consumer Law.
Changes to the Community
FemPowered is a developing community and its programme, format and delivery may evolve over time.
FemPowered may make reasonable changes to session dates, venues, facilitators, event formats, resources, programme structure, activities and other aspects of the Community where reasonably necessary for operational, commercial or member-experience reasons.
Where reasonably practicable, members will be given advance notice of material changes.
FemPowered will not rely on this provision to materially reduce the overall nature or value of a member's paid membership without reasonable notice.
Where a material change substantially affects the service a member originally agreed to purchase, the member may have the right to cancel or seek another remedy in accordance with Australian Consumer Law.
Member Events and Experiences
Community membership may include access to certain member-only activities and may provide preferential pricing or member discounts on selected separately ticketed FemPowered events and experiences.
Eligibility, availability, pricing and the applicable discount will be communicated for each experience and may be subject to specific booking terms.
Member benefits and discounts have no cash value and are not transferable unless expressly agreed by FemPowered.
3. Advisory Services
Engagement
The scope and nature of Advisory Services will be agreed between FemPowered and the client through a proposal, written agreement or other written confirmation.
Unless otherwise agreed in writing, Advisory Services are provided on a month-to-month basis.
Cancellation
Either party may end an ongoing Advisory engagement by providing at least 28 days' written notice.
Fees falling due during the notice period remain payable and FemPowered will continue to make the agreed services available during that period unless otherwise agreed between the parties.
Client Participation
Advisory Services are collaborative in nature. Clients remain responsible for providing timely information, access, decisions and participation reasonably required for FemPowered to provide the agreed services.
Delays caused by a client's failure to provide required information, access or participation do not automatically entitle the client to a refund, fee reduction or extension of the engagement.
In-Person Advisory & Travel Expenses
Where FemPowered provides Advisory Services in person, reasonable travel and associated expenses incurred specifically in connection with delivering those services may be charged to the client in addition to the agreed Advisory fee.
This may include reasonable transport, flights, accommodation and other necessary travel-related expenses.
Where reasonably practicable, significant travel expenses will be discussed with the client in advance.
Travel expenses relating to Advisory Services are separate from the travel arrangements and expenses of attendees participating in FemPowered events.
4. Events
Booking Confirmation
An event booking is confirmed upon receipt of full payment or an approved deposit where expressly offered.
For multi-day events, the booking secures the attendee's place together with the accommodation, meals, activities and other inclusions expressly outlined in the event information.
Unless otherwise stated, places cannot be held without payment.
Event Changes
FemPowered will make reasonable efforts to deliver events substantially as advertised.
However, FemPowered may make reasonable changes to speakers, facilitators, venues, agendas, activities, timings, meals or other inclusions where reasonably necessary.
Where a significant change is required, FemPowered will communicate this to affected attendees as soon as reasonably practicable.
Nothing in this provision limits an attendee's rights under Australian Consumer Law.
Event Cancellations by Attendees
Unless otherwise stated for a particular event, payments and deposits are non-refundable for change-of-mind cancellations, except where a refund or other remedy is required under Australian Consumer Law.

Replacement Attendees
If an attendee is unable to attend an event, they may request approval to transfer their place to a suitable replacement attendee.
Requests must be made in writing and are subject to approval by FemPowered.
Where an approved replacement cannot be arranged at least seven (7) days before the event, payments already made may be forfeited, subject to any rights available under Australian Consumer Law.
Late Arrival, Non-Attendance or Early Departure
No refund, credit or discount will ordinarily be provided where an attendee arrives late, does not attend or chooses to leave an event early, subject to Australian Consumer Law.
External Bookings and Expenses
FemPowered is not responsible for independently booked travel, accommodation, childcare, work-related costs, travel insurance or other third-party arrangements associated with attending an event.
Attendees are responsible for understanding the cancellation and refund policies applying to their own third-party bookings.
5. Event Changes Beyond Our Reasonable Control
If an event cannot proceed as planned due to circumstances beyond FemPowered's reasonable control — which may include natural disasters, extreme weather, public health emergencies, government restrictions, civil unrest, transportation disruption, venue closure or significant supplier failure — FemPowered may reasonably cancel, postpone, relocate, reschedule or modify the event.
Where this occurs, FemPowered will communicate with affected attendees as soon as reasonably practicable and will endeavour to provide an appropriate alternative where reasonably possible.
Any refund, credit, replacement service or other remedy will be determined having regard to the circumstances and any rights available under Australian Consumer Law.
FemPowered is not responsible for independently incurred costs such as flights, accommodation, childcare or lost income except where liability cannot lawfully be excluded.
6. Community & Professional Conduct
FemPowered is designed to provide a supportive, respectful and professionally constructive environment.
Members, clients and event attendees are expected to treat other participants, FemPowered representatives, facilitators, suppliers and venue staff respectfully.
FemPowered may take reasonable action where behaviour is inappropriate, discriminatory, threatening, offensive, seriously disruptive, unsafe or materially inconsistent with the safe and respectful operation of the Community, Advisory engagement or event.
Depending on the circumstances, this may include a warning, restriction of participation or removal from an event, programme or Community.
Where reasonably appropriate, FemPowered will provide the participant with an opportunity to address the issue before terminating an ongoing membership or engagement.
Serious misconduct or behaviour creating an immediate safety or wellbeing concern may result in immediate removal.
Any refund or other financial remedy will be determined having regard to the circumstances and Australian Consumer Law.
7. Confidentiality Within the Community
FemPowered encourages open and meaningful discussion between members and participants.
In participating in Community sessions, Advisory activities or FemPowered events, you acknowledge that other participants may share confidential, commercially sensitive or personal information.
You agree to respect the confidentiality of information clearly shared in confidence and not to disclose another participant's confidential business or personal information outside the relevant FemPowered environment without their permission.
This does not prevent a person from disclosing information where required by law or where disclosure is reasonably necessary to address a serious safety concern.
Participants remain responsible for exercising reasonable judgment regarding the information they choose to share.
8. Health, Wellbeing & Participation
FemPowered services and events are designed to support personal and professional development.
Some sessions may involve reflection, discussion, coaching-style activities, physical activities, travel, outdoor environments or other experiences.
Participants are responsible for determining whether participation is appropriate for their own circumstances and wellbeing.
Where appropriate, participants should obtain relevant professional advice before participating.
Participation is voluntary and attendees remain responsible for their own decisions, actions, health and wellbeing.
9. No Professional Advice & Responsibility for Decisions
FemPowered provides business education, facilitation, community and advisory support.
Unless expressly agreed otherwise in writing, information, resources, conversations, workshops and Advisory Services do not constitute legal, accounting, taxation, financial, investment, medical or psychological advice.
FemPowered may discuss business strategy, leadership, people, operations, commercial decisions and other business matters as part of its services. However, clients and members remain responsible for their own business, financial and personal decisions and for determining whether independent professional advice is required.
Where specialist advice is appropriate, participants should consult a suitably qualified professional.
10. Intellectual Property
All materials provided by FemPowered before, during or after a Community activity, Advisory engagement or Event — including presentations, workbooks, templates, frameworks, activities, recordings, graphics, written content, methodologies and learning resources — remain the intellectual property of FemPowered Pty Ltd unless otherwise stated.
Materials are provided for the personal or internal business use of the registered member, client or attendee.
FemPowered materials must not be copied, reproduced, adapted, distributed, published, recorded, shared, sold, licensed, delivered as training material or otherwise commercially exploited without prior written consent from FemPowered.
Participants are welcome to apply concepts, tools and learnings within their own business or professional practice.
However, reproducing, teaching, distributing or representing FemPowered's proprietary frameworks, materials or training content as your own, or using them for commercial gain, is prohibited without written permission.
FemPowered reserves all intellectual property rights in its content, branding, materials, methodologies and resources.
11. Photography, Recording, Feedback & Marketing
Photography and Recording
FemPowered may photograph, film or record portions of events and Community activities for promotional, educational and archival purposes.
Where photography or filming is planned, FemPowered will endeavour to make participants reasonably aware.
By participating, you consent to reasonable use of your image, voice and likeness in FemPowered marketing and promotional materials unless you notify FemPowered in writing that you do not wish to be photographed, filmed or used in this way.
Feedback and Testimonials
Feedback voluntarily provided through surveys, emails, testimonials or other communications may be used by FemPowered for internal improvement.
FemPowered may also use feedback for marketing purposes where permission has been provided or where it is otherwise reasonable and lawful to do so.
12. Pricing, GST & Payments
All prices are quoted in Australian Dollars (AUD) and are exclusive of GST unless expressly stated otherwise.
Customers are responsible for ensuring that payment details provided to FemPowered or its payment provider remain valid and current.
Where a recurring payment fails, FemPowered may reasonably attempt to process the payment again and may contact the customer to arrange payment.
FemPowered may suspend access to paid services where amounts remain overdue after reasonable notice.
13. Liability
Participants voluntarily choose to participate in FemPowered services, Community activities and events and remain responsible for their own decisions and actions.
To the extent permitted by law, FemPowered is not responsible for indirect or consequential loss arising from participation in or reliance upon its services, or for loss arising from circumstances outside FemPowered's reasonable control.
Nothing in these Terms excludes, restricts or modifies a consumer guarantee, right, remedy or liability that cannot lawfully be excluded or limited under Australian Consumer Law or other applicable legislation.
Where FemPowered's liability may lawfully be limited, it will be limited to the maximum extent permitted by law.
14. Privacy
FemPowered may collect personal information in connection with memberships, Advisory Services, events, enquiries and other interactions with the Company.
Personal information will be used for legitimate business purposes including service delivery, administration, communications, event management and customer support and will be handled in accordance with applicable Australian privacy requirements.
Where FemPowered uses third-party platforms or service providers to deliver its services, relevant information may be processed through those providers subject to applicable privacy requirements.
15. Changes to These Terms
FemPowered may update these Terms and Conditions from time to time to reflect changes to its services, business operations or legal requirements.
Updated Terms will apply to future purchases from the date they are published.
For existing ongoing Community memberships or Advisory engagements, FemPowered will provide reasonable notice of any material change that may significantly affect the customer's rights or obligations.
FemPowered will not rely on this provision to retrospectively remove rights or remedies that have already accrued or to exclude rights available under Australian Consumer Law.
16. Australian Consumer Law
Nothing in these Terms and Conditions excludes, restricts or modifies any consumer guarantee, right or remedy available under the Australian Consumer Law or any other applicable legislation that cannot lawfully be excluded, restricted or modified.
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be read down or severed to the extent necessary without affecting the remaining provisions.
